Summary of Rental Terms & Conditions

  1. When you have agreed with us the dates for your holiday we will send you an invoice for 25% of the basic holiday cost. We will confirm your booking on receipt of this non-refundable deposit and let you know when the balance of the rental cost has to be paid. Once the deposit has been paid and the reservation confirmed, you will have no automatic right to cancel the booking and will be liable for the full rental cost. Reservations made within 8 weeks of the start of the rental period must be paid for in full at the time of booking.
  2. The balance of the rent, together with the security deposit (see clause 3) is payable not less than 8 weeks before the start of the rental period. If payment is not received by the due date, we reserve the right to give notice in writing that the rental is cancelled. In all cases of cancellation by you, you will remain liable for the balance of the rental unless we are successful in finding a suitable alternative client. We will be under no obligation to agree to allow you to assign your booking.
  3. A security deposit of £500 is required in case of any damage to the property or its contents and to cover the use of the telephone. However, this sum shall not limit your liability to us and you agree to reimburse us in full for any damage or costs we incur as a result of your occupation of the property.
  4. We will account to you for the security deposit and refund the balance due to you, less a retention of £200 for the telephone, within 14 days of the end of the rental period. We receive a telephone bill from France Telecom every two months. Within 14 days of receipt of the next telephone bill after your stay, we will refund the balance of the security deposit, less any deductions for telephone calls you have made. You agree to pay for any telephone calls in excess of the balance of the security deposit.
  5. The rental period shall commence at 4.00 p.m. on the first day and finish at 10.00 a.m. on the last day. On the day of arrival or departure, outside these times you may leave packed luggage in the games room in the basement.
  6. The maximum number of people to reside in the property must not exceed the number of adults and children agreed between us and shown on the reservation confirmation.
  7. The rent paid covers the supply of sheets and towels for domestic use but not beach or pool towels. It also covers all gas and electricity and the supply, but not use of, the telephone.
  8. You agree to take good care of the property and its contents and to leave the property in a clean and tidy condition at the end of the rental period. Although a final clean is included in the rental price, we reserve the right to make an appropriate deduction from the security deposit to cover additional cleaning costs if you leave the property in an unacceptable condition.
  9. Additional cleaning or sheet changes during your stay can be arranged with us in advance and you will be asked to pay Mme Benhamou (who looks after the property for us) direct for this service. You should immediately let Mme Benhamou or us know about any breakages or damage which occurs during your stay.
  10. You agree not to act in any way that would cause a disturbance to other occupants of Domaine St Pierre and you agree to abide by all the rules and regulations of the domaine.
  11. We shall not be liable to you for any temporary defects or stoppage in the supply of public services to the property nor in respect of any equipment, machinery or appliance in the property. Any defects should be reported to Mme Benhamou or to us and will be rectified as soon as possible.
  12. Whilst we have taken every care to ensure that La Caille Perdrix is a safe environment in which to enjoy your holiday, you should recognise that the garden has steep paths and the pool is not enclosed. It is therefore your responsibility to ensure that children are closely supervised at all times and that all occupants take care to ensure that there are no accidents. We shall not be liable for any loss damage or injury you might incur unless it is proved that it is due to our own negligence.
  13. Following recent changes in French law regarding pool safety, we have fitted a security alarm which complies with current legislation. This alarm should be kept activated at all times (full instructions will be found in the house) and we accept no liability if it is deactivated for any reason. The presence of the alarm does not in any way alter your responsibility to ensure that children are closely supervised at all times, particularly in and around the pool area. Please exercise great care when using the pool and observe normal small swimming pool safety rules, such as no diving, running round the edges or taking glass containers to the pool surround.
  14. The swimming pool will be serviced regularly. Please call Bela Benhamou or us in the first instance if you are concerned about any aspects of the pool maintenance. (All necessary numbers are in the information pack in the house).
  15. Under no circumstances shall our liability to you exceed the amount paid for the rental period. In the unlikely event that we have to cancel the booking due, for example, to damage to or destruction of the property, our liability shall be restricted to a refund of all sums previously paid by you to us in respect of the rental period.
  16. The agreement between us shall be governed by English law and any proceedings arising out of it may only be brought in a court of competent jurisdiction in England.
